Restatement Determination Letters: The end is in sight
Presentor: Derrin Watson Recorded Date: 9/28/2015 Duration: 60 Min.

This program was recorded during a live presentations given on September 28, 2015 at 12:00PM EST.

The IRS is getting out of the determination letter business for individually designed plans, other than issuing letters when a plan is established and when it terminates. The effects of this decision can be profound on individually designed plans, and could carry over to preapproved plans (prototype and volume submitter). We still don’t know the full plans of the IRS; they have asked for comments in several areas. Those comments could affect the remedial amendment period and plan corrections.

In this special 60 minute program, Derrin discusses what we know and what we don’t know about this important change, and some of the issues involved for plan sponsors.

Topics include:

  • Background and existing rules
  • Announcement 2015-19
    • Scheduled end of 5-year cycle
    • End of off-cycle filings
    • End of extended remedial amendment period
  • Questions from the IRS
  • Questions from practitioners
  • Strategies for now and later
